These website terms and conditions (“Website Terms”) apply to your use of Premier Eco Cards Limited’s website at www.premierecocards.co.uk (the “Website”). You should read these Website Terms carefully. By accessing or using the Website, you confirm that you have read, understood and agree to these Website Terms. You should also be aware that when you agree to these Website Terms you shall be deemed also to have read, understood and agreed to PEC’s Privacy Policy.
Disclaimer
To the extent permitted by applicable law, Premier Eco Cards Limited (“PEC”) disclaims all representations and warranties, express or implied, that content or information displayed in or on this Website is accurate, complete, up-to-date and/or does not infringe the rights of any third party.
Viruses
PEC uses reasonable efforts to ensure that this Website is free from viruses and other harmful content. PEC cannot however guarantee that your use of this Website (including any content on it) will not cause damage to your computer or other device. It is your responsibility to ensure that you have antivirus software to enable you to use the Website safely and to screen out anything that may damage or harm your computer or other device. Except as otherwise provided by law PEC shall not be liable to any person for any loss or damage they suffer as a result of viruses or other harmful content that they access from or via the Website.
PEC excludes all representations, warranties, conditions and terms (whether express or implied by statute, common law or otherwise) to the fullest extent permitted by law. PEC accepts no liability for any losses or damages which are not reasonably foreseeable arising out of or in connection with these Website Terms or your use of the Website.
Liability
Nothing in these Website Terms shall exclude or limit PEC’s liability for personal injury or death caused by PEC’s negligence. Except to the extent required by applicable law PEC shall not be liable for any loss or damage which may arise from the use of or reliance on any content or information displayed in or on this Website.
These exclusions shall be governed by and construed in accordance with English law. If any provision of these exclusions shall be unlawful, void or for any reason unenforceable then that provision shall be deemed severable and shall not affect the validity and enforceability of the remaining provisions.
Third Parties
Only PEC and you shall be entitled to enforce these Website Terms. No third party shall be entitled to enforce any of these Website Terms, whether by virtue of the Contracts (Rights of Third Parties) Act 1999 or otherwise.
Entire Agreement
These Website Terms (including, where applicable, our Privacy Policy and PEC’s Terms and Conditions of Sale (see below)) set out the entire agreement between you and PEC and supersede any and all prior terms, conditions, warranties and/or representations to the fullest extent permitted by law.
Jurisdiction
Any matter that arises out of your use of this Website (including any contract entered between you and PEC through the Website) shall be governed by English law and subject to the exclusive jurisdiction of the courts of England and Wales.
Changes to Website Terms
PEC reserves the right to change and update these Website Terms from time to time. By continuing to access and use this Website, you will be deemed to have agreed to any changes or updates to the Website Terms.
Terms and Conditions of Sale
By placing an order through the Website, you confirm that you have read, understood and agree to PEC’s terms and conditions of sale in their entirety.
(a) Goods and service descriptions
PEC have taken reasonable precautions to try to ensure that prices quoted on the Website are correct and that all goods and services have been fairly described. PEC reserves the right to vary the specification or description, withdraw, modify or amend any goods on the Website without prior notice. When ordering products or services through the Website, you should note that orders will only be accepted if there are no material errors in the description of the goods or services or their prices as advertised on this Website.
(b) Acceptance of orders
Completion of the online checkout process does not constitute PEC’s acceptance of your order. PEC’s acceptance of your order will take place only when PEC confirm in writing by e-mail that your order has been accepted.
(c) Price
All prices are displayed in pounds Sterling exclusive of UK VAT unless expressly indicated otherwise. Prices for goods may change from time on the Website, but any such changes will not affect any orders in respect of which PEC have already sent you a dispatch confirmation.
(d) Checkout process
During the checkout process, you will be asked to complete your payment details. All fields indicated as compulsory must be completed. Please note that PEC will collect and store your personal information (but not payment details) and will only use your personal information in accordance with PEC’s Privacy Policy (see above). Payments will be handled by Stripe or PayPal who will handle payment details in accordance with their respective security policy which can be viewed at either www.stripe.com/docs/security/strip or www.paypal.com/uk/webapps/mpp/paypal-safety-and-security
(e) Delivery
Delivery will be to the UK address specified in your order.
Notwithstanding delivery, all products that you order through the Website will remain the property of PEC until full payment has been received for them.
All risk in the products you order (including risk of loss and/or damage to the products) shall pass to you when they are delivered to the delivery address specified in your order.
PEC shall be under no liability for any delay or failure to deliver products if the delay or failure is wholly or partly caused by circumstances beyond PEC’s control.
(f) Payment
All card payments are subject to authorisation by your card issuer. PEC will take payment once it has checked your card details and the availability of goods and materials to meet your order.
If PEC is unable to supply you with the product or service you ordered or if it is not possible to process your payment, your order will not be processed. PEC will use all reasonable endeavours to contact you by e-mail and/or telephone to advise you accordingly but shall have no liability to you resulting or arising from the non processing of your order . In the event that you have already paid for the goods or services PEC will refund you as soon as is reasonably possible.
(g) Your right to cancel
If you are a UK/EU consumer, you have the legal right, under the Consumer Protection (Distance Selling) Regulations 2000 to cancel your order in writing within seven working days following your receipt of the goods (“the cancellation period”) . If you wish to exercise this cancellation right you must send your cancellation notice to sales@premierecocards.co.uk
IMPORTANT: You should be aware that the legal rights of cancellation under the Distance Selling Regulations available for UK or EU consumers do not apply to products which at your request have been personalised in any way or made to your specification.
You must take reasonable care of any goods that you wish to return. You must not use them and you should return them to PEC in their original packaging. You will be responsible for the cost of returning the goods if you cancel your order during the cancellation period.
If you cancel goods pursuant to your rights under the Distance Selling Regulations and at the time of cancellation you have already paid for the goods PEC will refund your money
(a) within 30 days of you cancelling your order if the goods have not yet been dispatched to you ; or
(b) within 30 days of receipt of the returned goods if the goods have been dispatched to you. You must notify PEC by e-mail returns@premierecocards.co.uk of any returned goods that you have sent.
Any refunds given by PEC will be made to the debit/credit card account provided when you placed your order.
(h) Damaged goods, discrepancy or shortage of order
You must check all goods you receive against your order. If the goods you receive are damaged or incorrectly supplied or there is a shortage of the goods you must notify PEC immediately on delivery or if you are unable to view the items on receipt, you must inform PEC (by post, phone or e-mail only) within 48 hours of delivery You must return the goods to PEC as soon as possible after informing PEC that the goods are damaged or have been incorrectly supplied. PEC will replace the goods or where this is not possible PEC will refund the cost of the goods (including a refund of the delivery charges for returning the goods to PEC) to the debit/credit card account provided when you placed your order.
(i) Damage to goods during the course of return
PEC will not be responsible for any loss or damage to any goods which you return to PEC. If returned goods are lost or damaged in transit, PEC reserve the right to charge you (or not to refund any amounts attributable to) such loss or damage.
(j) Liability
Nothing in these terms and conditions of sale shall limit PEC’s liability for personal injury or death caused by PEC’s negligence or for fraud.
As a consumer you have certain rights, including legal rights relating to faulty or incorrectly described goods. Nothing in these terms and conditions of sale shall affect these legal rights and PEC will perform its obligations hereunder with reasonable care and skill.
All goods supplied by PEC will be of satisfactory quality. If goods are delivered to you that are not of satisfactory quality PEC will replace the goods or where this is not possible PEC will refund the cost of the goods (including a refund of the delivery charges for returning the goods to PEC).
PEC will only be responsible for losses that are a natural, foreseeable consequence of PEC’s breach of these terms and conditions of sale. PEC will not be liable to you if PEC is prevented or delayed from complying with its obligations under these terms and conditions by anything you (or anyone acting on your behalf) does or fails to do or due to events which are beyond PEC’s reasonable control.
In any event PEC will not be liable for any losses related to any business of yours including (without limitation) lost data, lost profits, lost revenues or business interruption.
(k) Miscellaneous provisions
These terms and conditions of sale may be updated or amended by PEC from time to time to comply with the law or to meet PEC’s changing business requirements without notice to you. Any updates or amendments will be posted on the Website.
These terms and conditions of sale supersede any other terms and conditions previously published by PEC and any other representations or statements made by PEC to you, whether oral, written or otherwise.
If any court of competent jurisdiction shall find any of these terms and conditions of sale to be illegal, invalid or unenforceable, the remaining clauses of these terms and conditions of sale shall remain in full force and effect.
No third party shall be entitled to enforce any of these terms and conditions of sale, whether by virtue of the Contracts (Rights of Third Parties) Act 1999 or otherwise.
These terms and conditions of sale are governed by English law. In the event of any matter or dispute arising out of or in connection with these terms and conditions of sale PEC and you agree to submit to the exclusive jurisdiction of the English courts.
